Judge Rules Against Mr Brainwash in Run DMC Photo Copyright Lawsuit

Last January, Glen E. Friedman sued Mr Brainwash because he used without credit or permission his iconic photo of Run DMC on various pieces.
Judge Harry Pregerson ruled againt Thierry Guetta and here is what he said :
“To permit one artist the right to use without consequence the original creative and copyrighted work of another artist simply because that artist wished to create an alternative work would eviscerate any protection by the copyright act,”

This decision could potentially be pretty bad for other artists working in the US, because this could limit their ability to freely use manipulated images in their work.
The transformative fair use law had previously been seen as a strong defense against copyright claims in such cases.

A separate hearing will determine how much Mr Brainwash will have to pay Glen E. Friedman for this copyright infringement.
